General Liability vs. Professional Liability: Which Does Your Minnesota Business Need?

Your Clients, Your Work: Two Reasons to Review Liability Coverage.

You finish a productive meeting with a customer, send the next steps, and get back to work. Insurance probably does not cross your mind. Yet that ordinary interaction contains two different kinds of exposure: something could happen to the customer while visiting your office, or the customer could later claim your advice caused a financial loss.

For a Minnesota business that provides services, understanding that difference is a useful starting point. You do not need to memorize policy language before asking questions. You need a clear picture of what you do, who relies on your work, and what a serious complaint could cost to resolve.

Start with the kind of harm alleged

General liability commonly addresses claims involving bodily injury, damage to someone else’s property, and certain personal or advertising injuries. Professional liability, often called errors and omissions or E&O, focuses on allegations involving professional services, mistakes, or negligence. The Travelers comparison of these coverages explains why businesses may need both.

Think of two questions rather than two competing products. Could someone say your operations injured them or damaged their belongings? Could someone say they relied on your professional work and suffered a loss because it was wrong, incomplete, or late? Those questions can point toward different coverage discussions.

A designer, consultant, or other service provider should not assume that working carefully eliminates the possibility of an allegation. The relevant question is how the policy responds to a covered claim, including its defense provisions, rather than whether you believe a customer would ultimately win.

Describe your services, not just your job title

Your business name may not reveal everything you do. A company that began with administrative support might now offer recommendations, manage projects, or implement software. A contractor might also prepare designs. Bring a current description of these activities to your insurance review.

Include your typical deliverables, customer types, largest projects, subcontracted work, and geographic reach. Ask whether every service appears within the policy’s insured activities. A broad-sounding title on a quote does not replace the definition inside the actual form.

The Travelers general liability overview also distinguishes everyday liability exposures from professional negligence. Use that distinction to review proposals without assuming that one insurer’s examples describe every policy available to your business.

Pay attention to when a claim must be reported

Many professional liability policies use claims-made coverage. The claim date, reporting requirements, and any retroactive date can matter alongside when the work occurred. An extended reporting option may address certain later-reported claims, but it does not simply provide unlimited coverage for new work after a policy ends. The Hartford’s professional liability explanation describes these timing concepts.

If you are changing insurers, retiring, selling the business, or dropping a service, ask for a continuity review before canceling anything. Keep the prior policy and relevant project records. Ask how circumstances that might become claims should be reported, rather than waiting for formal court papers.

Also ask whether legal defense costs reduce the limit available to pay damages, what deductible or retention applies, and whether your consent is required for a settlement. These are comparison questions, not assumptions about how all policies work.

Read contracts alongside the insurance

A new client may request particular limits or coverage language. Send those requirements to your agent before signing when possible. Your attorney can assess contractual obligations; your insurance professional can help explain whether the proposed policy aligns with them.

Neither general nor professional liability should be treated as a substitute for insurance on your own equipment, workers’ compensation, or an appropriate auto policy. Create a simple map of your business: people, property, vehicles, services, and data. Then identify which policy addresses each category and which questions remain open.

Your practical coverage checklist

  • Write a plain-language list of every service you currently provide.
  • Gather client insurance requirements and any existing policy declarations.
  • Compare insured activities, limits, exclusions, deductibles, and defense provisions.
  • Record claims-made reporting rules and retroactive dates where applicable.
  • Ask about gaps before adding services, signing a major contract, or canceling coverage.

Coverage depends on the specific policy, endorsements, facts, and applicable law. These examples are educational and do not establish that a particular claim is covered.
