Renting a Car? What Minnesota Drivers Should Check Before the Counter

Rental Car Insurance Questions? Answer Them Before the Counter.

You have reached the rental counter, your bags are beside you, and the representative asks whether you want additional protection. That is an inconvenient time to start interpreting your auto policy. A better decision begins before the trip, when you can compare the rental agreement with coverage you already have.

Minnesota drivers have an important state-specific issue to review. Advice written for a national audience may assume rental damage depends on collision coverage. Minnesota’s rules can work differently, which is a good reason to ask targeted questions rather than automatically accepting or declining every product.

Understand Minnesota’s distinctive rental protection

Minnesota Statutes section 65B.49, subdivision 5a, requires qualifying personal auto policies to address damage and loss of use to certain rental vehicles through property damage liability coverage. Where that liability limit is below $35,000, the statute provides $35,000 for this rental coverage. It also extends specified other auto coverages to qualifying rentals.

The statutory definition and exceptions matter. A rental agreement lasting longer than one month is outside this provision’s rental definition, and some vehicle and policy categories are excluded. This is not a promise that any vehicle, anywhere, for any purpose is covered.

The Minnesota Attorney General’s rental-car guidance advises consumers to understand existing coverage before purchasing optional products. It also notes that foreign travel or a desire for additional liability protection can create reasons to consider extra coverage. Bring the actual destination and reservation details into the conversation.

Separate the products offered at the counter

A collision or loss damage waiver generally concerns the rental company’s ability to hold you responsible for specified vehicle damage or loss. Read the agreement for exclusions and required conduct. It is different from liability protection for injuries or property damage you cause to others, and different again from personal accident or belongings coverage.

Ask what each product adds beyond your existing protection. Which expenses are covered? What limits apply? Who handles a claim? Are there restrictions on drivers, roads, countries, vehicle types, or uses? A product name alone does not answer these questions.

Do not let a quick yes-or-no question hide the real decision. You can request the terms before travel and compare them calmly. If you decline a waiver, understand the responsibilities you retain under the rental contract. If you accept one, understand the circumstances that could void it. Neither choice should rest on a blanket statement that additional protection is always necessary or always wasteful.

Check card benefits and the trip itself

A credit card may offer rental-car benefits, but the specific benefit guide controls. The NAIC’s auto insurance consumer resource recommends checking with the card company. Ask whether you must charge the full rental to that card, decline the rental company’s waiver, and meet particular driver, location, vehicle, or duration requirements.

Also ask whether the benefit is primary or secondary and what documentation a claim requires. Do not assume card protection includes liability for injuries to other people. Save the current benefit guide rather than relying on what the card offered when you opened the account.

Before pickup, confirm every intended driver is authorized under the rental agreement. At pickup and return, photograph the vehicle’s condition when safe and permitted, keep the agreement and receipts, and obtain a return confirmation. If damage occurs, follow both the rental company’s and insurer’s reporting instructions promptly.

One final distinction helps: rental reimbursement on your own auto policy generally addresses the cost of temporary transportation after a qualifying loss to your vehicle. It is not the same question as coverage for damage to the vehicle you rent on vacation.

Your before-you-rent checklist

  • Share the destination, rental dates, vehicle type, drivers, and purpose with your insurer.
  • Ask specifically how Minnesota’s rental-vehicle provision applies to your policy and reservation.
  • Read the rental agreement’s damage, loss-of-use, and additional-fee provisions.
  • Obtain the current credit-card benefit guide and verify all eligibility steps.
  • Compare optional products by the protection they add, not only their daily price.
  • Keep claim contacts, photographs, the agreement, and return records together.

If you would like to work through those questions before departure, contact David Olson at Intrinsic Insurance with your policy and reservation details. A little preparation can turn the counter conversation into a decision you already understand.

This is general information, not legal advice. Rental contracts, card benefits, policy terms, statutory exceptions, and travel destinations affect coverage. Confirm your specific arrangements before relying on any protection.
